WeFi: Your personal finance app that helps you take control of your finances and achieve your goals.
weFi Personal Finance App is a mobileand web application developed and owned by MYFIBOT LLC, a limited liability company registered in the State of New Jersey.
These Terms of Service come into effect as of December 12, 2024.
weFi is a personal finance app, offering educational and informational content relating to personal finance, credit monitoring, debt monitoring, savings potential monitoring and other related matters.
Further, weFi offers tools to assist with establishing and maintaining alerts, reminders, spending caps, debt payment targets, financial to-do lists, and other personal finance related activities.
The content published on weFi may consist of informative videos, articles and tutorials. The information provided is for reference and informational purposes. Users of weFi recognize that the content provided is not intended to be construed as financial advice, nor should MYFIBOT LLC be construed as a financial advisor of any kind.
The present Terms of Service provides the terms upon which users are provided with content, information, data, videos, tools and other features on weFi. These Terms of Service will apply to you upon accessing, browsing, using or downloading weFi.
In these Terms of Service, MYFIBOT LLC is referred to as “weFi”, "we", “us”, “our” and other similar expressions.
“Content” refers to all information, data, videos, tutorials, materials and content published on the Mobile App, which relate to personal finance, debt, credit, investments and financial information. The Content will be available to users of the Platform, either as part of a membership or otherwise.
“Dispute” refers to a dispute arising out of or relating to these Terms of Service.
“Terms of Service” refers to the present Terms of Service and include any and all amendments, modifications and supplements made hereto from time to time.
“Tools” refers to tools and features accessible and made available on the Mobile App.
“weFi App” or the “Mobile App” refers to the mobile application named weFi: Personal Finance App, as developed and owned by MYFIBOT LLC.
Users of the Platform are individually referred to as “you”, “your” and other similar expressions.
When accessing, visiting, downloading, browsing or otherwise using the Mobile App, you are deemed to have accepted these Terms of Service in full. Accordingly, your usage, browsing and/or downloading the Mobile App constitutes and is construed as your acceptance of these Terms of Service.
These Terms of Service constitute a binding and enforceable agreement between you and weFi. You acknowledge that weFi is not bound by any agreements, terms or policies, except for the present Terms of Service and any other policies explicitly named herein.
It is your responsibility to read and review these Terms of Service in full prior to using the Mobile App. Moreover, you are encouraged to read and review these Terms of Service periodically to ensure you are familiar with the latest version thereof.
By using the Mobile App, you confirm that you read and understood these Terms of Service in their entirety. You further agree to be bound by these Terms of Service as though you manually signed them.
As a user of the Mobile App, you are required to act with integrity, in compliance with applicable laws and the obligations set forth in these Terms of Service and other policies developed by weFi, which are or will be published on the Mobile App.
If you do not agree with these Terms of Service, even in part, your sole recourse is to not use the Mobile App.
To use the Mobile App, the Content and/or the Tools, you confirm the following to weFi:
(i) You are at least thirteen (13) years old.
(ii) Your usage of the Mobile App will, at all times, comply with all applicable, international, federal, state and local laws and regulations.
(iii) You are not subject to any restrictions that would prevent you from accessing or using the Mobile App and/or creating an account on the Mobile App.
(iv) You are not engaged in any activities that compete with those of weFi. Further, you confirm that you are not a competitor of weFi and your usage of the Mobile App is for your own personal use, and not for a business or to create competition for weFi and/or the Mobile App.
(v) You have and possess the necessary authority to enter into these Terms of Service.(vi) Your usage of the Mobile App does not conflict with any order, judgment, agreement or relationship to which you are legally bound.
(vii) Your usage of the Mobile App does not infringe upon any rights of weFi, including any copyrights, intellectual property rights or rights of any nature held by weFi.
(viii) You are solely responsible for acquiring and maintaining the required equipment, software and Internet access needed to use the Mobile App.
The Mobile App’s Content focuses on personal finance monitoring as it relates to credit, debt, savings and income. The Content is provided for reference, educational and informational purposes only. The Content should not be construed as investment or financial advice. Your usage of the Mobile App and the Content provided thereon is at your sole risk, and expense.
weFi does not guarantee that the Content provided on the Mobile App will be complete, accurate, current, useful, or helpful for your purposes. You are responsible for using the Content at your sole risk. If you proceed with decisions or actions based on the Content, you recognize that these decisions and actions are at your sole risk as the Content is not financial advice, nor is the Content personalized for you or for your needs.
weFi disclaims all liability with respect to the accuracy, suitability, completeness, quality, and appropriateness of the Content available on the Mobile App. Some Content may consist of a user’s opinion, and should not be relied upon as financial or professional advice.
weFi reserves the right to modify, change, remove, add or withdraw any Content, materials and Tools available on the Mobile App. The prices for memberships on the Mobile App may be updated by weFi at any time at its discretion.
weFi may discontinue, suspend, or modify the Mobile App, without notice and without liability to you. Any updates, modifications, removals, additions or other changes to the Mobile App will be governed by these Terms of Service.
weFi may provide you with an update regarding changes on the Mobile App through a notification, email, or by displaying a banner on the Mobile App. You understand and agree that you may not receive a notification of updates to the Mobile App from weFi.
You confirm the following to weFi:
a) you acknowledge that weFi cannot make any guarantees regarding your personal finances, and you agree that usage of the Content may drive in unexpected financial results,
b) you are responsible for any and all acts and omissions that occur in connection with your usage of the Mobile App and the Content,
c) you recognize and acknowledge that weFi or the Mobile App is not acting as a broker, financial advisor, investment advisor or agent for you, rather weFi is providing information and Content for general reference purposes,
d) you recognize that financial decisions, loans, credit and other similar matters may involve a significant amount of risk and weFi cannot be held responsible if decisions or actions performed in reliance upon the Content fail to yield positive results,
e) weFi will solely provide the Content and Tools available on the Mobile App, which are provided as is without warranties or guarantees of any nature, and
f) the Content and the Tools are not intended to be used as financial, loan, or investment advice, or security information.
Some Content and Tools may be based on actual, simulated or hypothetical information. You recognize that such information is provided solely as an example, and does not in any way guarantee that the results published as part of the Content may be replicated. You therefore assume all responsibility for any decisions and actions you may make based, in full or in part, on the Content, the Tools or the Mobile App.
You are aware of and recognize the financial risks associated with financial decisions, loans, credit and other similar matters. You confirm that any financial activities and information inputted in the Tools will be done voluntarily and with the knowledge that financial losses may result from using the information provided as part of the Content and Tools. You are aware that any financial activities may result in financial loss. When rendering decisions or engaging in actions or omissions regarding financial activities, you agree to assume all risks associated therewith.
In no event will weFi be deemed in default of its obligations under these Terms of Service or applicable law or be liable in any way by reason of the failure of your financial performance or poor financial situation.
Even though the Content and Tools may be based on calculated methods and outcomes, weFi cannot guarantee that the Content on the Mobile App will produce any particular result with respect to your needs or expectations.
The Content and Tools should not be regarded as a substitute for a financial advisor, investment advisor, or other professional’s judgment. When making any decisions relating to your finances, weFi recommends you seek a professional’s opinion, where necessary.
In consideration of the above, you agree to assume all risks associated with decisions, actions and omissions made on the basis of the Content and Tools. weFi declines all responsibility and liability for actions, inactions and decisions made by you in reliance upon the Content and Tools.
When you provide us with your mobile phone number or email address, you understand and agree that weFi may contact you at that number or email address using text messages with service-related information such as One-Time Passwords (OTP). Message and data rates may apply.
You certify, warrant and represent that the telephone number and email address you have provided to us is your contact information and not someone else’s telephone number or email address. You represent that you are permitted to receive text messages at the telephone number you have provided to us and emails at the email address you have provided us. You agree to promptly alert us whenever you stop using a telephone number or email address and if your contact number or email address changes.
You can cancel the SMS service at any time. You can cancel the SMS service by texting “STOP” to the short code (i.e., replying to the SMS message). After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed from SMS messages. After this, you will no longer receive SMS messages.
If you are experiencing issues with the SMS messaging program, you can reply to the message with the keyword “HELP” for more assistance, or you can get help directly by emailing us at support@wefiapp.com.
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies and depends on the amount of times you would require an OTP. If you have any questions about your text plan or data plan, you should contact your wireless provider. Carriers are not liable for delayed or undelivered messages.
We may modify or terminate our email and/or SMS messaging services from time to time, for any reason and without notice, including the right to terminate email and/or SMS messaging. Please review the Privacy Policy for additional information.
To use the Mobile App and purchase a membership, you must create a user account. To create a user account, you will provide personal information, such as your name, residential address, and email address or phone number.
If you would like to use Tools to obtain credit information from the Mobile App, you will be required to provide your date of birth and the last four digits of your social security number (SSN). weFi may use such personal information to allow for credit monitoring, with your prior written approval. Your address will be required by the credit bureaus for matching and by weFi for billing if you opt for a premium membership.
To verify your identity, you will be required to input your email address or phone number, at your selection. Your email address or phone number will be verified, depending on the method you choose to sign in, via a One-Time Password (OTP). No additional verification will be required for account creation and identity verification. However, in connection with the linking of your bank transactions or credit bureau data, you will be required to undergo further verification through third-party service providers.
Any personal information submitted will be stored and handled in accordance with weFi’s Privacy Policy.
Unless otherwise specified, all user accounts on the Mobile App will be secured by a password. Your username is personal to you, and your selected password must remain confidential for security purposes. You understand that you may be held responsible for any payment incurred with respect to your user account.
If you suspect that your user account may have been compromised or subject to a breach, please notify weFi in accordance with the requirements set forth in these Terms of Service. You further agree to immediately inform weFi of any apparent breaches of security such as loss, theft or unauthorized use of your username or password.
To protect your privacy and user account, please change your password immediately if you believe your password has been compromised.
The features and tools offered on the Mobile App will only be accessible to fee paying members. The monthly membership fee will be specified on the Mobile App. You will be fully responsible for the monthly membership purchased under your user account.
You will be liable for the monthly membership fees purchased unless you notify weFi of a security issue, breach or compromise of your user account prior to its occurrence.
To pay for your membership, you may be required to provide your valid and current credit card information or bank account information. You understand that upon making a payment on the Mobile App, your credit card or bank account will be charged for the amount of the purchase.
You consent to weFi storing, or using a third party to store, your payment information on file to provide for recurring payments.
Upon purchasing a membership to the Mobile App, you will be charged the membership fees on a recurring monthly basis until you cancel your subscription. Unless you notify weFi of your intention to not renew your membership on the Mobile App, your membership will automatically renew for subsequent periods, and your payment information will be charged according to the applicable payment schedule. weFi reserves the right to cancel your membership if your payment information is no longer functional, valid or usable. You remain fully responsible for ensuring your payment information remains valid and up to date, and for immediately informing weFi of any changes to your payment information.
weFi acknowledges that billing errors may occur. In case of a billing error, weFi requests that you send a written notice detailing the alleged error and the resolution sought. weFi will review all such notices, and refund your account, if appropriate to do so as determined by weFi.
Unless otherwise indicated, the payments for memberships are exclusive of any taxes, duties and levies. You are responsible for paying all taxes charged in connection with your purchase of a membership on the Mobile App.
weFi will not grant refunds for monthly membership plans. Considering your access to the Content and Tools as a result of a membership, any used months will not be refunded or reimbursed by weFi
You are responsible for using the Mobile App in accordance with these Terms of Service and applicable laws and regulations.
While using the Mobile App, you agree to not engage in any of the following prohibited behavior:
- Using the Mobile App to violate or infringe any applicable law, regulation or policy, including legislation applicable to finances and securities such as the U.S. Securities and Exchange Commission;
- Using the Mobile App in a way that could damage, overburden or impair the Mobile App;
- Using the Mobile App for any unlawful or illegal purpose or in a way that is fraudulent, malicious, misleading or otherwise discriminatory, or encouraging others to use the Mobile App for such purposes;
- Transmitting a virus or harmful components or scripts on or via the Mobile App;
- Impersonating an individual, entity, business, or company, or otherwise misleading others about your true identity or qualifications;
- Using, transmitting, reproducing, or otherwise sharing trademarks, patented materials, marks, logos or other intellectual property published on the Mobile App without the intellectual property owner’s consent and approval;
- Accessing the Mobile App by way of illicit or automated means, such as using a bot or a spider;
- Reproducing, copying or otherwise sharing Content from the Mobile App without having obtained the required consents and permissions;
- Hacking, decompiling disassembling, or reverse engineering the Mobile App or any portion thereof;
- Requesting or initiating chargebacks, refunds or reimbursements for sums paid to weFi for the membership;
- Damaging, destroying, disabling or otherwise impairing the Mobile App or any portion thereof;
- Selling, assigning or otherwise transferring your user account, without having obtained weFi’s prior written permission;
- Engaging in behavior that is contrary to the intent of these Terms of Service, could give rise to liability, damages, costs or expenses for weFi.
If you violate or breach any of the conditions and obligations set forth herein, weFi may remove or suspend your access to the Mobile App, or terminate your account on the Mobile App.
The Content and the Tools published on the Mobile App are proprietary to weFi and may not be reproduced or shared without weFi’s prior written consent. Copyright © 2024 MYFIBOT, LLC. All information, data and Content published on the Mobile App is protected by copyright, intellectual property laws and trademark laws. All rights relating thereto are reserved. The reproduction, transmission, sharing and distribution of all or part of any of the information on the Mobile App is expressly prohibited, except as permitted in these Terms of Service.
weFi reserves all available rights in connection with the Content, Tools and Mobile App, including, without limitation, intellectual property rights, title, ownership and other rights. weFi is the sole owner of the Content, the Tools, the Mobile App, any marketing materials provided on the Mobile App, derivative work, the services and the products offered by weFi.
weFi owns the Content published on the Mobile App, or weFi has secured valid licenses to publish the Content on the Mobile App. Any Content that has been licensed weFi will remain the property of its respective owners.
weFi grants you a limited revocable license to copy and use the Content on the Mobile App for personal, non-commercial use and reference purposes. You are not authorized to use the Content on the Mobile App for commercial or business purposes. You agree not to reproduce, copy, edit, modify, distribute, transmit or otherwise share the intellectual property and Content on the Mobile App with any third party, except with our prior specific written consent.
In consideration of the license granted by weFi, you agree to protect the Content from unauthorized access and illicit distribution. You recognize that such Content is protected by intellectual property laws, and you agree not to use the Content for any illicit or illegal purpose.
weFi may revoke the limited license granted to you at any time if you violate these Terms of Service, or if you use the Content for any purpose not explicitly authorized by these Terms of Service. If your limited license to use the Content has been revoked, terminated or expired, you agree to delete and destroy all materials obtained from the Mobile App. You are not authorized to retain any materials obtained from the Mobile App.
weFi reserves the right to investigate, verify, evaluate and otherwise look into any potential violations of these Terms of Service, any policies set forth by weFi, or applicable legislation, regulations or binding terms. You agree to fully cooperate with weFi during the course of any such investigations by submitting documentation as requested or providing information upon request by weFi.
In its sole discretion or upon request by a user of the Mobile App, weFi may delete, remove or otherwise withdraw any content or user account which violates these Terms of Service, or could otherwise be deemed problematic as determined by weFi at its sole discretion. weFi is under no obligation to remove, delete, withdraw or otherwise suspend a user account.
weFi reserves the right to terminate your user account upon the occurrence of the following: (i)your usage of the Mobile App breaches these Terms of Service, any applicable law or is contrary to public interest; or (ii) you failed or neglected to pay the sums due on their due date.
weFi may also terminate your user account for any reason that it considers appropriate, at its sole discretion and without notice.
You may terminate your user account at any time by following the instructions for canceling your user account on the Mobile App.
You may submit ideas, concepts, information, techniques, suggestions, data and feedback to weFi regarding the Mobile App and any improvements thereof. You agree to grant weFi a perpetual, irremovable, worldwide, unlimited, royalty-free, unpaid, assignable and sublicensable license to use your feedback to improve the Mobile App or in connection with the Mobile App. The license to the Improvements will allow weFi to use, distribute, share and employ your feedback without requiring any additional consents or permissions.
Your membership will automatically renew for the same term, every month, unless you cancel your user account.
weFi may cancel your user account upon your request. You recognize that you will not be entitled to any refunds for the monthly membership fees already paid.
You may cancel your user account, at any time, by selecting the appropriate option on the Mobile App, or by sending an email to weFi. Any cancellation request made by phone, fax or other means will not be processed by weFi. Your user account will be canceled upon weFi’s receipt of your cancellation request. The user account will be canceled by weFi according to its procedures and policies.
Once your user account is effectively canceled, you will no longer benefit from access to the Content and Tools on the Mobile App. weFi will cease to bill you on the effective cancellation date of your user account. Please note that weFi will not refund any fees already paid for your user account.
These Terms of Service apply to your usage of the Mobile App as of the effective date of the Terms of Service.
weFi may modify, update, amend or otherwise change these Terms of Service at any time, at its sole discretion. The latest version of these Terms of Service will be published on the Mobile App, and will specify the date of the updated revision. Any updates to these Terms of Service will be binding and effective upon their publication on the Mobile App.
Your continued use of the Mobile App following the publication of the updated Terms of Service constitutes your acceptance of the updated Terms of Service.
By providing personal information on the Mobile App, you allow weFi to use, communicate, share, disclose or otherwise reproduce your information on the Mobile App according to the terms of weFi’s Privacy Policy, unless you notified weFi that you do not permit the sharing of your information or data in advance. weFi will collect solely minimal personal information from users of the Mobile App. Subject to and contingent upon weFi’s receipt of your approval, weFi may share your personal information with credit bureaus and banks where you currently hold accounts to allow you to benefit from the Tools.
Your personal information and data will be handled according to weFi’s Privacy Policy. weFi’s Privacy Policy will be published on the Mobile App and available for review.
In an attempt to provide increased value, the Mobile App may provide links to websites and applications operated by third parties. The links to such third party sites are for reference and convenience. These links are not governed by these Terms of Service.
You acknowledge that weFi is not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such third party websites, applications, resources or sites. The inclusion of any link to a third party site on the Mobile App does not imply weFi’s endorsement or any association with such third party.
As a result, all usage and access to third party links will be at your sole risk. You acknowledge that the third party sites are subject to separate terms and policies.
You recognize that weFi is not registered under the U.S. Securities and Exchange Commission as an investment advisor. weFi is providing Content relating to financial matters as a “publisher’s exclusion” as set forth in Section 202(a)(11) (D) of the Investment Advisers Act of 1940 and corresponding state laws.
weFi’s Content should not be construed as individual and personalized investment advice. The Content is impersonal and is not intended to be relied upon to make investment choices. The Content is provided solely for information and reference purposes. The Content and the Tools are solely intended to help you manage your finances.
weFi takes reasonable steps to make sure the Content remains appropriate, educational and updated. Nevertheless, the Content on the Mobile App is provided “as is” and “as available”. weFi reserves the right to suspend the Mobile App’s operations at any time, for any reason at weFi’s discretion and without prior notice. weFi will not assume any liability whatsoever if, for technical or other reasons, the Mobile App is out of operation, or if any information contained thereon has not been properly updated.
Neither the Content nor any information provided on the Mobile App will be construed as financial or other type of advice. You recognize that weFi is not acting as a broker, financial advisor or investment specialist, nor does weFi hold any licenses or permits to this effect.
The Content should not be relied upon in isolation for rendering decisions regarding financial, debt management, credit and similar matters. The Content should not be treated as a substitute for your own judgment. weFi will not be responsible for the outcome of any decisions and interventions resulting from your reliance upon the Content provided on the Mobile App.
You agree to fully release and discharge weFi from all claims, losses, damages, liabilities and causes of action of every nature, that you may have or had against weFi arising from or related to the Content, the Tools and any information published on the Mobile App, or the Mobile App itself. In consideration of the foregoing, you agree not to file or cause to be filed any claims, actions, lawsuits or legal proceedings against weFi in connection with any matter arising out of or as a result of the Mobile App.
The Mobile App, the Content and the Tools are provided “as is” and “as available” without any warranties of any nature, whether express, implied, or statutory. To the fullest extent permitted by applicable laws, weFi disclaims any and all warranties, including express, implied and statutory warranties, such as warranties of merchantability, fitness for a particular purpose and non-infringement of proprietary rights. Without limitation to the foregoing, weFi further disclaims any warranties relating to the security, availability, suitability, quality and performance of the Mobile App.
weFi does not warrant that: (i) the Mobile App will be available at all times, without interruption and error; (ii) the Content and the Tools available on the Mobile App are accurate, valid, current and reliable; (iii) any defects, omissions or errors with respect to the Mobile App will be immediately corrected or corrected at all; and (iv) any Content or Tools available through the Mobile App are free of harmful components.
You acknowledge that weFi is not responsible for any service interruptions, including, without limitation, power outages, system failures or other interruptions beyond its reasonable control.
In consideration of the disclaimers set forth above, you agree that your usage of the Mobile App and any Content and Tools provided thereon is at your sole risk, discretion and expense. You may be held responsible for any claims, costs, expenses and fees incurred in connection with your usage of the Mobile App, and you agree to release weFi from all liability in connection therewith.
weFi uses reasonable commercial efforts to ensure the Content is as accurate as possible. However, weFi does not warrant that the Content on the Mobile App is accurate, complete, reliable, current, or error-free.
To the extent permitted by applicable law, weFi, its members, officers, directors, affiliates, agents and employees will not be liable for any and all claims, demands, actions, causes of action, judgments, incidental damages, punitive damages, exemplary damages, indirect damages, losses, liabilities, costs and expenses including, without limitation, interest, penalties, fees, disbursements and charges arising out of or in connection with your usage of the Mobile App and the Content, and regardless of whether or not weFi was aware of the possibility of such damages.
To the fullest extent permitted by law, weFi’s aggregate liability under these Terms of Service will be limited to the amount you paid for the membership during the six (6) months immediately before the event that gave rise to the liability.
Technical Issues:
You recognize that technical issues may arise when using the Mobile App. Such issues may delay, suspend, terminate or completely prevent access to the Mobile App. We will not be liable for any loss, damage or other adverse effects caused by the Mobile App.
Further, we disclaim all liability for: (i) issues affecting our servers, including unauthorized access to personal information and data; (ii) service interruptions or other issues affecting the Mobile App, its features or its servers; and (iii) any virus or other harmful component impairing the Mobile App or a device used to access the Mobile App. For purposes of these Terms of Service, harmful material consists of viruses, spyware, adware or other programs and codes intended to harm computer software or hardware.
Exclusion of Damages:
To the fullest extent permitted by applicable law, weFi declines and excludes full liability for any losses and damages arising out of or in connection with the Mobile App, the Content and the Tools, including but not limited to indirect, general, special, punitive and incidental damages.
Further, we are not liable for any indirect, special or consequential loss or damages arising from your access and/or usage of the Mobile App, including but not limited to loss of profits, loss of revenue, loss of business or anticipated earnings, loss of goodwill, loss of privacy, emotional distress, pain and suffering and personal injury.
Permitted Scope:
The exclusions of warranty, limited liabilities, disclaimers and releases set forth in these Terms of Service are subject to the limitations and extent permitted by applicable laws. In the event of a conflict between the exclusion, limited liability, disclaimer or release and applicable laws, the applicable laws will prevail and control. The exclusion, limited liability, disclaimer or release will then be drafted to preserve the original intent, considering legal limitations and obligations.
Indemnification:
You agree to indemnify and hold weFi, its members, officers, directors, affiliates, agents and employees harmless from and against all losses, damages, liabilities, costs and expenses, including attorney fees, in connection with any claims, actions, proceedings, investigations or suits brought by a third party, arising out of
- your breach of any representation or warranty provided pursuant to these Terms of Service,
- your breach or failure to comply with any of these Terms of Service, applicable laws or regulations and/or
- your negligent, problematic or reckless usage of the Mobile App, the Content or any information available on the Mobile App.
Territorial Limitations:
The Mobile App is intended solely for residents of the United States. weFi does not represent or guarantee that the Content published on the Mobile App is appropriate or available to users located outside of the United States. Users of the Mobile App who do not reside in the United States recognize that all or part of the information on the Mobile App may not be available or suitable in regions outside the United States.
If you choose to access the Mobile App from outside the United States, you will be responsible for complying with all laws applicable in your country of residence.
No waiver by weFi, whether by conduct or otherwise, of any of these Terms of Service will be enforceable, except if such waiver is expressly provided in a duly executed written instrument by weFi’s duly authorized representative. Further, such waiver will not constitute a continuing waiver unless expressly indicated in such instrument.
Any section or provision of these Terms of Service which is, or becomes, illegal, invalid or unenforceable will be severed from these Terms of Service. The severed portion of these Terms of Service will be ineffective. The remaining Terms of Service will remain valid and enforceable.
These Terms of Service, together with any document referred to herein, constitutes the entire agreement between you and weFi with respect to the subject matter hereof. These Terms of Service supersede all prior negotiations and agreements between you and weFi regarding the subject matter hereof.
weFi may assign all or part of its rights and obligations hereunder to any person, entity, business or company. You may not assign all or part of your rights and obligations hereunder to any person, without weFi’s prior written consent. Any assignment that does not comply with the requirements of these Terms of Service will be null and void.
No waiver of any of the provisions of these Terms of Service will be deemed or constitute a waiver of any other provision nor will such waiver constitute a continuing waiver unless otherwise expressly provided.
Any notice, consent, authorization, direction or other communication required or permitted to be given under these Terms of Service must be in writing and delivered using any delivery method with proof of receipt to MYFIBOT’s headquarters or by email.

Notices may be delivered to weFi using any of the following acceptable delivery methods: (i) any type of mail, provided with proof of receipt, (ii) certified mail, or (iii) email with acknowledgement of receipt.
As weFi may communicate with you by email, you are responsible for providing a current and valid email address. If the email address you provided is invalid, any notice weFi sends to the email address provided will be deemed effective as per these Terms of Service.
These Terms of Service, any claim under these Terms of Service and all matters relating thereto are governed and construed according to the laws of the State of New Jersey and the applicable laws of the United States.
Any Disputes will be governed and handled according to this Section.
Jurisdiction of the Courts:
The following types of Disputes may be brought before the competent courts located in the State of New Jersey: (i) Disputes instituted to seek an injunction or other equitable relief, or (ii) Disputes instituted to enforce any rights and obligations set forth in these Terms of Service. Any such Disputes will be submitted to the competent courts in the State of New Jersey. You agree to submit to the exclusive jurisdiction of such courts.
All other Disputes will be resolved exclusively by mandatory arbitration, unless you opted out of the arbitration process in accordance with these Terms of Service.
Opting Out:
To opt out of the arbitration process, you must send us a written request prior to creating an account on the Mobile App. We will review all opting out requests, and we will approve those which comply with the requirements of these Terms of Service.
If your opting out request is approved, any Dispute involving you will be transferred to and handled by the competent court in the State of New Jersey, rather than arbitration.
Good Faith Negotiations:
Prior to commencing any arbitration proceeding, you agree to use your best efforts to resolve the Dispute informally by good faith negotiations.
Arbitration Proceedings:
If the Dispute cannot be resolved amicably within a reasonable delay, the Dispute will be referred to arbitration. The arbitration proceedings will be held and conducted according to the standards of the American Arbitration Association. The arbitration will be presided over by one (1) arbitrator, unless the nature of the Dispute requires otherwise. The language used in the arbitration will be English. The arbitration award will be confirmed in writing.
The arbitrator may award damages and relief, similarly to a court of law. The arbitration award will be final and binding, not subject to appeal.
Nothing in this section will prevent us from seeking relief before a court of competent jurisdiction to protect our interests.
Remedies and Injunctions:
You acknowledge that any breach of these Terms of Service may cause us significant harm and damages, especially if related to data security, intellectual property or unauthorized usage of the Mobile App.
Further, monetary damages may not be sufficient for a breach of these Terms of Service. We will be entitled, without waiving any other rights or remedies, to seek any injunctive or equitable relief as may be deemed proper by a court of competent jurisdiction.
Waivers of Jury Trials and Class Actions:
Any arbitration proceedings brought or instituted in connection with Disputes will be individual and not class arbitration. As such, Disputes will be brought in your individual capacity, and not as a class action or consolidated as part of another party’s Dispute. You agree to not enter into any class action or consolidating claims with other users of the Mobile App. You further waive your right to a jury trial.
Time Frame:
Any Dispute relating to these Terms of Service must be introduced within one (1) year from the event giving rise to the claim. Any Dispute introduced after the one (1) year period will be barred.
